PURCHASING FIREARMS ONLINE
IF I BUY A GUN ONLINE, CAN I SHIP IT TO YOU?
Many people choose to buy firearms from online auction sites or online retailers and have them shipped to their local gun shop, where they'll begin the paperwork process and undergo a background check prior to taking possession of their firearm. DAVIS GUNWORX is happy to help you with this.
If you want to purchase a handgun or revolver and have it shipped in, the handgun or revolver MUST be listed on the Department of Justice's roster of handguns certified for sale in the state of California unless you are an exempt person (list of exemptions HERE) or in rare instances, the firearm is exempt (Single Action Revolver, Curio and Relic). If you purchase a firearm online and have the firearm shipped to DAVIS GUNWORX and the firearm is not approved for sale in California the firearm will have to be shipped back to the online retailer from which it was purchased. You will be billed a $60 service fee before we ship the firearm back. The online retailer will likely charge you return shipping and a re stocking fee. Save time and money, please check before you purchase something. Please be aware that as of July 1st 2021 PC 27510 and PC 27535 (a) prohibits a person from making an application to purchase more than one handgun or semiautomatic centerfire rifle within a 30 day period. This subdivision does not authorize a person to make an application to purchase both a handgun and a semiautomatic centerfire rifle within the same 30-day period. If you ship a handgun and a centerfire semi automatic rifle in to DAVIS GUNWORX, please be aware of our firearms storage policy found on our Terms Page.
The list of approved handguns can be found HERE
A summary of California's assault weapons ban can be found HERE
HOW MUCH WILL IT COST?
-The state charges $37.19 for the background check, which we are required to collect on their behalf.
-If the online retailer does not collect sales tax, please be aware that the California Department of Tax and Fee Administration requires that sales tax (7.75%) be collected on the purchase and shipping price of anything you have shipped to DAVIS GUNWORX.
-DAVIS GUNWORX charges $75.00 per firearm as our fee.
-If you do not already have a Firearm Safety Certificate (FSC) or have a current exemption, you'll need to take (and pass) the Firearm Safety Certificate Test. We'll issue you your new certificate on the spot. With a few exceptions a FSC is required to purchase a firearm in CA. There is a $25 fee associated with having a FSC issued.
-California has gun lock requirements that may require you to purchase a gun lock. You do not have to purchase a gun lock from us. We do have gun locks available for purchase for $10.78 (including tax).
WHAT DO I DO AFTER I MAKE MY ONLINE PURCHASE?
Once you have made your online purchase, please e-mail a copy of your invoice or receipt to justin@davisgunworx.com so that paperwork can be transferred to the seller and arrangements to have the firearm shipped here can be made. We will reply to your e-mail to notify you that your purchase has been addressed and information has been exchanged.
You will be notified when your online order arrives and we'll schedule an appointment for you to come by and start the paperwork process. You'll need to bring a few documents with you. (Please see FLOWCHART below.)
More info about the sales tax requirement placed on gun shops can be found HERE.
I ORDERED A GUN (AND/OR AMMO) ONLINE FROM A RETAILER OR AUCTION SITE, NOW WHAT?
Please email us a copy of your invoice or receipt. Please send it to: justin@davisgunworx.com. If you purchased from gunbroker.com, please send the Gunbroker invoice to the above email.
WHAT DO I NEED TO BRING TO MY APPOINTMENT?
To purchase a pistol you must bring the following documents with you:
-Valid California Driver License or ID Card (if yours says "Federal Limits Apply", you'll also need to bring your birth certificate or passport with you) We can't start the background check without these documents present.
-Proof of residency (automobile registration, utility bill in your name with your current address and dated within the previous three months) The full list of acceptable Proof of Residency documents can be found HERE
-Firearm Safety Certificate (FSC) or proof of exemption, If you don't have an FSC, you can take the test with Davis Gunworx. There is a $25 fee to have a safety certificate issued after the successful completion of a FSC test. Ca DOJ has a study guide which can be found HERE.
-If a gun lock wasn't included in your purchase/ shipment and you don't have a valid exemption (you own a DOJ approved safe or you're a credentialed LEO, or the firearm qualifies as an "antique") you'll need A DOJ approved Firearm Safety Device AND a printed receipt showing purchase within 30 days of the end of DROS. Gun locks are available for sale. They are $10.78 including tax.
-Payment in full. Cash, check, credit and debit cards are all accepted.
-A bit of patience, California requires that applicants wait (10) ten 24 hour periods after the paperwork process is started before the firearm can be released to them (and on the condition that they pass the background check). Law also requires that we do a firearm safe handling demonstration. This takes time. Please be patient.
Law Enforcement Officers ONLY:
If you're purchasing an off roster handgun or item(s) restricted to LEO's only, you MUST bring your LEO ID with you to show proof of exemption.
HOW DO I BUY A GUN?

-You must be 21 years of age or older.
-You must have valid Proof of Age and Identity
-You must have a Firearms Safety Certificate (or proof of exemption)
-You must have valid Proof of Residency (handgun or pistol only)
All firearms purchases and transfers, including private party transactions and sales at gun shows, must be made through a licensed dealer. Driver License or ID cards that read "Federal Limits Apply" are not valid as proof of age or identity.
If the buyer is not a U.S. Citizen, then he/she is required to demonstrate that he/she is legally within the United States by providing documentation to the firearms dealer that contains his/her Alien Registration Number or I-94 Number.
Purchasers of firearms are also required to have a valid Firearm Safety Certificate (FSC), or have a valid proof of exemption. If you do not have a FSC, you can take the 30 question T/F, Multiple Choice test for a $25 fee. A certificate can be issued upon successful completion of the FSC test. The FSC Study Guide is available online and can be found HERE.

HOW DO I PURCHASE AMMUNITION IN CA? CAN I PURCHASE AMMO ONLINE ANYMORE?
California has passed prop. 63 which requires individuals to purchase ammunition in a face to face setting. This means, If you purchase ammo online, (with few exceptions) you can NOT have it shipped directly to your home or work. You must have it shipped to an entity with an ammunition vendor's license, such as a gun shop. The Ammunition vendor is required by the California department of tax and fee administration to collect sales tax on the purchase and shipping cost of the ammo. Tax in Sacramento is 7.75%. A Vendor may also charge a fee to process that transaction. Our fee is $20.00 per vendor.
AMMUNITION ELIGIBILITY (BACKGROUND) CHECKS:
California law now requires that individuals who purchase ammunition undergo an eligibility check prior to gaining access to that ammunition. The state charges $1 per transaction fee for a "Standard Ammunition Eligibility Check" which applies if the prospective ammunition purchaser is already in the database. There is a $19 fee to conduct a "Basic Ammunition Eligibility Check" for prospective ammunition purchasers who are not in the database. Purchasing a long gun on or after Jan 1, 2013 will have entered you into the database. The Standard Ammunition Eligibility Check is supposed to be nearly instant.
For additional information, please refer to the California Code of Regulations, Title 11, Division 5, Chapter 4 SS 4045. Definitions and requirements.
CAN I PURCHASE A HANDGUN AND A SEMI AUTO CENTERFIRE RIFLE UNDER THE SAME DROS OR WITHIN A 30 DAY PERIOD?
Starting July 1st 2021, Penal Code Section 27510 and PC 27535 will be in effect.
PC 27535 (a) A person shall not make an application to purchase more than one handgun or semiautomatic centerfire rifle within any 30-day period. This subdivision does not authorize a person to make an application to purchase both a handgun and a semiautomatic centerfire rifle within the same 30-day period.
There are exemptions for police officers.
MY DRIVER LICENSE IS EXPIRED/ IS NO LONGER VALID/ SAYS "FEDERAL LIMITS APPLY". CAN I STILL BUY A GUN?
Does California law permit the use of a temporary license as a form of identification for firearm purchases?
Neither temporary driver's licenses nor temporary identification cards are accepted forms of proof of identity and age. Expired or invalid driver license are also not accepted.
(PC Section 12071 (c)(1)).
My Driver License or ID says "Federal Limits Apply" in the top right corner, will this prevent me from purchasing a firearm or ammunition?
Without additional documentation, yes, this will prevent you from making a purchase. HOWEVER, if you bring with you one of the following documents, you will meet the qualifications for proof of identity, which are:
-Valid, unexpired U.S. passport or passport card
-Certified copy of U.S. birth certificate
-Certification of birth abroad (FS-545), Certification or report of birth (DS-1350) or consular report of birth abroad of a citizen of the USA (FS-240), issued by the US Department of State
-Valid, unexpired foreign passport with valid U.S. immigrant visa and approved record of arrival/ departure (I-94) form
-Certified copy of birth certificate from a U.S. territory
-Certificate of naturalization or U.S. citizenship
-Valid, unexpired permanent resident card.
WHAT'S THE DEAL WITH AR'S IN CALIFORNIA? CAN I STILL HAVE A "BULLET BUTTON™"?
Since January 1, 2000, California has defined Category 3 “assault weapons” by various generic characteristics. Specifically, any semi-automatic, centerfire rifle that has the “capacity to accept a detachable magazine,” and has any of the characteristics described in subsections (A)-(F) of Penal Code Section 30515(a)(1) would qualify as an assault weapon, subject to all of the restrictions, limitations, and requirements of the AWCA. In light of these extensive restrictions and requirements, understanding what constitutes a “detachable magazine” has become critical to California firearm owners seeking to comply with state gun legislation. Section 5469(a) of the California Code of Regulations defines a “detachable magazine” to mean “any ammunition feeding device that can be removed readily from the firearm with neither disassembly of the firearm action nor use of a tool being required. ...” (11 CCR §5469(a)). To recap, under previous law (pre Jan 1, 2017) there were two exceptions to the definition of detachable magazine: the first requires that the firearm action first be disassembled to remove the magazine, and the second is for magazines that can only be removed by using a tool.
On July 1, 2016, California Governor Brown signed SB-880 into law. Under SB-880, there is only one exception to the definition of the detachable magazine, which is the “disassembly of the firearm action” exception; the “use of a tool” exception will no longer exist after the new legislation takes effect on January 1, 2017.
Bullet-Button™ is the registered trademark of its owner.
HOW LONG CAN I WAIT TO PICK UP MY GUN AFTER DROS ENDS?
Is there a maximum time limit for me to pick up a gun after the dealer submits the DROS information?
Yes. If you do not take physical possession of the firearm within 30 days of submission of the DROS information, the dealer must cancel the sale. If you still want to take possession of the firearm, you must repeat the entire DROS process, including payment of DROS fees.
(PC sections 12071, 12072)
DO I HAVE TO BUY A GUN LOCK? WHAT IF I ALREADY OWN ONE?
What is the Firearm Safety Device (FSD) law?
Generally, all firearms (other than federally defined antiques) purchased in California must be accompanied with an FSD that has passed required safety and functionality tests and is listed on the Department of Justice Roster of Approved Firearm Safety Devices. The current roster is available on the Bureau of Firearms website at http://oag.ca.gov/firearms/fsdcertlist.
Are there any exceptions to the Firearm Safety Device (FSD) requirement?
Yes. The FSD requirement does not apply to the following:
Persons who can demonstrate the purchase of a Department of Justice-approved safety device in the 30 days prior to taking possession of the firearm by presenting the device to the firearms dealer and providing the firearms dealer with a receipt showing the purchase date and model name of the device.
The commerce of any firearm defined as an "antique firearm" pursuant to federal law.
The commerce of any firearm intended to be used by a salaried, full-time peace officer for law enforcement purposes.
Transfers of firearms to persons who demonstrate ownership of a qualifying gun safe. Ownership may be demonstrated by displaying to the firearms dealer: 1) a receipt indicating purchase of, or an affidavit, signed under penalty of perjury, stating that the purchaser owns a gun safe; and 2) an affidavit signed under penalty of perjury, stating the gun safe meets the standards set forth in DOJ regulations. (Pen. Code, §§ 23635-23690.)
